IMPORTANT (PLEASE READ!)
We at Cuba Photo Travel look forward to the opportunity to act as your booking agent. These terms and conditions (the "Agreement") describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms "we", "us" and "our" refer to Cuba Photo Travel. The term "you" “customer” or “client” refers to the customer visiting our website, booking a reservation through us or otherwise using our services
All itineraries provide a full time schedule of educational activities that will result in meaningful interactions between you and individuals in Cuba. U.S. law requires that all persons who participate in this program adhere to this full time schedule, and imposes on Cuba Photo Travel, the obligation to ensure such adherence.
It is very important that all travelers understand the cancellation policy. If it is not clear, please contact us for clarification and a complete description.
SELLER OF TRAVEL
Cuba Cultural Adventures LLC, doing business as (DBA): Cuba Photo Travel is registered with the State of Florida as a Seller of Travel. Registration No. ST40827.
A deposit of 30% per person is required to guarantee your reservation, which will be applied towards the cost of your tour. Major credit cards & direct deposits are accepted. The name/s of the person/s who is/are travelling is/are required to appear in all transactions/communications.
Any pending balance must be paid in full at least sixty (60) days prior to departure.
All cancellation notices must be received via email at email@example.com and will become effective as of the date the email was sent. See our cancellation policy below.

We cannot make exceptions to this policy for any reason including personal emergencies, unexpected weather, natural disasters or terrorism. Cuba Photo Travel also reserves the right to cancel any trip using our discretion if the safety of our travelers or staff should be compromised. Any airline tickets issued are subject to the carrier’s refund policy. In the event of cancellation, Cuba Photo Travel is not responsible for any loss incurred for non-refundable travel costs. In this case, refund of payments received by Cuba Photo Travel will constitute full and final settlement. We always recommend purchasing travel insurance to protect your travel investment.
Leaving an expedition in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of an expedition. No refunds will be given for unused hotel rooms, meals, sightseeing trips, or trek arrangements.
If we cancel the trip in progress, the participant will receive a prorated refund and/or a credit based on the number of days not completed on the expedition.
AIRLINE CHECK IN PROCEDURE
Cuba Photo Travel assumes no responsibility for any air and/or ground schedule changes. Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.
By registering for a Cuba Photo Travel trip, you acknowledge that you have voluntarily applied to participate on this trip and that you have read the description of the trip as it appears in the current catalog or website.
SUBJECT TO CHANGE
Prices and itineraries may vary without prior notice until the moment of booking. Itineraries may be altered during the trip depending on photographic interest upon decision of the accompanying photographer.
Traveling to Cuba with Cuba Photo Travel can be subject to a degree of flexibility, and the trip’s route, accommodation and modes of transport are subject to change without prior notice due to local circumstances. Itineraries have been carefully constructed to assure participants the best each destination has to offer; however, should events arise that are beyond our control, activities and hotel arrangements are subject to change without notice. The itineraries summarize typical areas you will explore. Be assured that we will make substitutions that are as similar in quality and interest as possible.
You further acknowledge that weather conditions may be severe, adverse and/or unpleasant and that medical services or facilities may not be readily available or accessible during some or all of the time you are participating on the trip.
FITNESS & HEALTH
The majority of the trip is not strenuous and anyone who is reasonably fit should be able to take part in most of the activities. You will need to be sufficiently fit to climb in and out of the tour van and be able to carry and manage your own photographic equipment. We may hike trails ranging from easy to moderate. Some hotels may require a brief walk up.
You are expected to be in reasonable shape and fitness and being able to walk for several hours at a normal pace as well as to take care of your own equipment. You could have to transport your own luggage and bags in airports and hotels.
You should also be aware that medical services or facilities might not be readily available during all or part of your trip. This could include emergency medical care, presence of physicians, or adequate medication.
Once a booking has been accepted, medical circumstances will not be considered as exceptions to the cancellation policy. If you have any special needs or any physical condition that you feel might prevent you from fully participating, please contact us at firstname.lastname@example.org.
Travel arrangements, logistics, bookings, support, insurance, and everything related to the activity of a Travel Agent are organized by Cuba Photo Travel, a licensed FL Travel Agent, in accordance with the laws in force.
While travelling with Cuba Photo Travel you agree to accept the authority of the leader or local operator at all times. The customer understands that Cuba Photo Travel reserves the right to decline, accept, or retain any person as a member of the group at any time.
The participant acknowledges that he/she is aware that such a the trip he/she is undertaking in remote areas of the world implies a risk of illness, injury or death which may be caused by forces of nature, illness, or by willful or criminal conduct of third parties or by terrorism. You acknowledge that travel to foreign countries entails unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to yourself, to property, or to third parties. You understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: the hazards of walking on uneven terrain (cobblestones) and slips and falls, street muggings, hijacking, your own physical condition.
BY OFFERING FOR SALE TRAVEL TO CUBA, CUBA PHOTO TRAVEL DOES NOT REPRESENT OR WARRANT THAT SUCH TRAVEL IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL. YOUR PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CUSTOMER’S OWN RISK.
LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
Cuba Photo Travel acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“supplier(s)”), and is not the source or provider of the travel services. Each of these supplier companies is an independent entity with its own management, and is not subject to the control of Cuba Photo Travel. Customer is advised that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier’s Terms and Conditions are contained in printed form and are set forth on their respective Web sites, which govern the transaction. All bookings are accepted by Cuba Photo Travel as agent for the travel suppliers on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operator suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their respective Web sites.
BECAUSE CUBA PHOTO TRAVEL ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS, AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE CUBA PHOTO TRAVEL IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. CUBA PHOTO TRAVEL HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH CUBA PHOTO TRAVEL’S OFFICE OR THROUGH THIS WEB SITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF CUBA PHOTO TRAVEL’S CONTROL, AND YOU HEREBY EXONERATE CUBA CULTURAL ADVENTURES DBA CUBA PHOTO TRAVEL FROM ANY LIABILITY WITH RESPECT TO THE SAME.
Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of Cuba Photo Travel’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, is beyond the control of Cuba Photo Travel.
“Force Majeure” means, in relation to Cuba Photo Travel, any circumstances beyond the reasonable control of Cuba Photo Travel, (including, but without limitation, acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).
Cuba Photo Travel shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
If Cuba Photo Travel, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by Cuba Photo Travel to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although Cuba Photo Travel shall use its reasonable efforts to reimburse you where possible. However, Cuba Photo Travel shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to Cuba Photo Travel of the Force Majeure and applicable cancellation fees.
Regarding civil unrest, once Cuba Photo Travel has investigated the prevailing situation, as it deems fit, it shall remain in CUBA PHOTO TRAVEL’s sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to Cuba Photo Travel’s and each supplier’s terms and conditions.
MAXIMUM NUMBER OF PARTICIPANTS
The maximum number of participants are six (6) people in each individual tour. However, we reserve the right to add by up to one, the maximum number of participants, at any time.
It is highly recommended to purchase a medical and repatriation travel insurance package to protect oneself in case of an unexpected medical emergency. The Cuban government requires it upon entry. The applicant’s travel insurance must provide cover against personal accident, medical expenses, emergency repatriation and personal liability. We strongly recommend insurance coverage for cancellation be taken at the same time as payment is made, as no exception to the cancellation provisions that can be made. We strongly urge you to evaluate your risk and to take out insurance on your trip. It is vital for you to realize that if you experience a delay or find it necessary to cancel or cut short your trip for any reason, you will lose the entire sum you’ve invested in it.
Travel insurance helps to minimize the risk of monetary losses you would incur in the event of a delay of your departure due to weather, airline strike, missed connection, etc., your inability to travel for reasons such as illness, injury, unforeseen financial complications and other personal circumstances, or if you were required to cut your trip short for medical or any other reasons.
We also recommend provisions for curtailment, loss of luggage and personal effects. i.e. equipment insurance for your photography gear.
PASSPORT & VISA
The applicant must carry a valid passport Applicants must ensure their passport is valid for 6 months beyond the duration of the trip. The client acknowledges that it is solely his/her responsibility to ensure that he/she is in possession of the necessary travel documents that may be required including a copy of the proposed tour and itinerary as well as all health and other certificates that may be required from time to time. The client acknowledges that Cuba Photo Travel is not assuming any obligation or liability.
We further recommend to make two (2) color photocopies of your passport to bring with you on the trip. We advise you to carry your passport with you but leave a copy in your hotel safe. You can also scan your passport to keep on your mobile device.
When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids; examples are DHS-designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the data that is listed on airline ticket(s) and booking records.
Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov/app/answers/detail/a_id/268/kw/travel for forms.
The U.S. Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader.
You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing Customer to miss flight(s), and subsequent scheduled travel bookings on cruises and tours. Check each supplier’s website to ensure you and all members in your travel group or party obtain and carry travel documentation required.
When you receive any and all travel documents, it is your sole responsibility to review and verify all information. Contact Cuba Photo Travel immediately if changes or corrections are required.
Accommodations (hotels, tents, and cruise cabins) are based on double occupancy. If the participant prefers single accommodations, he/she must pay a single supplement fee, which is an option listed when making your booking. If the participant is traveling alone and wishes to share accommodations, we will assign him/her a roommate of the same gender. If there is no one with whom the participant can share, he/she is required to pay the single supplement fee.
Cuba Photo Travel reserves the right and permission to use any photographs or video we take of individuals on tour for use in promotional and publicity purposes. Cuba Photo Travel may use the photograph/video in publications or other media material produced, used or contracted by Cuba Photo Travel, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. Any person desiring not to have their photo taken or distributed must let us know in advanced of the trip via email email@example.com
We will NOT use YOUR photographs for any purpose without your express written consent.
